HYPOTHETICAL ADMISSION or PRESUMPTION OF TRUTH: When a motion to dismiss is filed, the material allegations of the complaint are deemed to be hypothetically admitted. This hypothetical admission, extends not only from the relevant and material facts well pleaded in the complaint, but also to inferences that may be fairly deduced from them.
